Cloakroom Operating Rules

These Cloakroom Operating Rules (hereinafter the “Cloakroom Operating Rules”) set out the rules and conditions for use of the cloakroom in the interior of Forum Karlín (hereinafter the “Cloakroom”). The Cloakroom is the only place to deposit items in connection with a visit to Forum Karlín and, for security reasons, the only place where such things are usually deposited. All customers using the Cloakroom in Forum Karlín are obliged to familiarize themselves with these Cloakroom Operating Rules and to comply with them. By handing over an item to the Cloakroom and accepting a confirmation of acceptance of an item, the customer accepts these Cloakroom Operating Rules and concludes with the Cloakroom operator, Forum Karlín a.s., registered office: Českomoravská 2345/17a, 190 00, Prague, business ID number: 08259551, registered in the Commercial Register maintained by the Municipal Court in Prague, section B, entry 24487, (hereinafter the “Operator”) a contract on storage of movable property, within the meaning of Sections 2402 and 1751(1) of Act No. 89/2012 Coll., the Civil Code, as amended.

  1. Operator. The Cloakroom is operated by the Operator, who is entitled to use the services of third parties for the Cloakroom’s operation, but is responsible for them as if it operated the Cloakroom itself.
  2. Operating hours and storage hours. The Cloakroom is open only during the time an event in the Forum Karlín building (hereinafter the “Event”) is being held, usually from the opening of the entrance to the public before the start of the Event until a maximum of 45 minutes after the end of the Event. Different Cloakroom hours will be communicated by being displayed next to the Cloakroom on the relevant day of the Event. The duration of the Event and the opening of the Cloakroom for the Event is the maximum agreed storage time.
  3. Payment for acceptance. The customer is obliged to pay the Operator the price stated in the Cloakroom price list in advance for the storage of items in the Cloakroom, or as indicated by the Operator. For each individual item deposited, the customer will pay this price to the Operator separately, unless the Operator stipulates otherwise. The customer will receive a document on the payment and acceptance of the item for storage in the form of a ticket with a unique identification code (hereinafter the “Ticket”). If the customer asks for a confirmation of the payment made, he/she is entitled to request it at the latest when the price for storing the item is paid. If the item is deposited in the Cloakroom for longer than the duration of the Event for which the item was deposited and the Cloakroom is open for the Event, the customer will also pay the price according to the price list for such an extended period of storage, usually paying it upon return of the item.
  4. Identifier. The item accepted will be marked with the same identifier as on the Ticket after it is accepted into the Cloakroom. The item accepted will be returned to the customer against the presentation of the Ticket, which the customer is obliged to hand over to the Operator upon acceptance of the item by the customer. Each item deposited in the Cloakroom requires its own Ticket, and multiple items cannot be deposited under one Ticket. Items for which a Ticket is not issued to the customer are not subject to a storage agreement or other obligation of the Operator. The Operator is not liable for the loss of an item if there is another item in an item deposited by the customer that does not have its own Ticket and it was lost, especially if the Operator was not demonstrably notified of the presence of such an item by the customer when the item was handed over to the Cloakroom.
  5. Return of item to the customer. The customer is obliged to collect items deposited in the Cloakroom before the Cloakroom closes after the Event ends without undue delay, no later than 45 minutes after the Event. Accepted items that are not collected from the Cloakroom before the Cloakroom closes after the end of the Event pursuant to Article 2 of the Cloakroom Operating Rules will be recorded and deposited at the place of the Operator’s registered office for 3 months. They will be issued to the owner upon presentation of the relevant Ticket, a valid ID document, recording of his/her name and address and date of birth, signing of the record of acceptance of the item (including its identification) and payment of the entire outstanding deposit fee specified in the Cloakroom price list. If the customer fails to collect items within the time limit specified above or if he/she does not pay the full deposit fee, the Operator has the right to dispose of the item as abandoned, or the right to dispose of the item at the expense of the customer, who is obliged to pay such costs without delay. In this case, the customer is not entitled to compensation for damages or any other detriment incurred in connection with the disposal of unclaimed items.
  6. Loss of Ticket. In case of loss of the Ticket, the Operator will allow the issue of the item after presentation a valid ID document by the customer, recording of the name, address and date of birth and payment of the full outstanding fee pursuant to the Cloakroom price list. The item will be released to the customer last, i.e. at the moment all other items from the Cloakroom have been issued, after a detailed description of the item by the customer. The Operator is not liable to the customer for damages if another person picks up the item using such lost Ticket.
  7. Deposited items. The customer is entitled to deposit only items whose depositing is necessary or usual for the purpose of attending the Event, especially outer clothing (coats, jackets, cloaks), and only in accordance with these Cloakroom Operating Rules. The Operator does not assume responsibility for items that the customer hands over to the Cloakroom in violation of the Cloakroom Operating Rules, especially if the Operator was not demonstrably notified of the presence of such items by the customer when handing over the item to the Cloakroom.
  8. Prohibited items. The customer may not place dangerous items (especially explosive, highly flammable, narcotic, psychotropic, toxic or otherwise dangerous substances, acids, firearms and ammunition, pressure vessels and other materials that may cause a danger to human health, the environment or property due to their chemical or physical properties), soiled, smelly or damaged items in the Cloakroom. Furthermore, under no circumstances may the customer deposit items in the Cloakroom that are not usually deposited in it. It is also prohibited to deposit live animals in the Cloakroom.
  9. Locked luggage. If the customer deposits luggage in the Cloakroom, the luggage must be locked or otherwise adequately secured against opening by an unauthorized person, otherwise it cannot be accepted into the Cloakroom. Luggage is considered adequately secured against opening if is possible to subsequently ascertain that the luggage was opened by an unauthorized person, including any seal with which the Operator is entitled (but not obliged) to provide the luggage, if technically possible. The item placed by the customer in the Cloakroom is only the luggage itself, and the Operator is not responsible for the loss of items from such luggage. However, the provisions of Article 7 (deposited items), Article 8 (prohibited items) and Article 11 (items of extraordinary value) of these Cloakroom Operating Rules will apply to items from luggage. The customer is obliged to complain about the fact that luggage was opened by an unauthorized person immediately upon return of the item from the Cloakroom, with later complaints being disregarded for understandable reasons.
  10. Refusal to accept items into the Cloakroom. The Operator reserves the right to refuse to accept an item in the Cloakroom, especially if the Cloakroom’s maximum capacity is reached, it is not an item pursuant to Article 7 or it is an item listed in Article 8 and/or unlocked luggage pursuant to Article 9 of the Cloakroom Operating Rules.
  11. Item of extraordinary value. If the customer intends to deposit an item in the Cloakroom whose value exceeds CZK 10,000 or keys, documents, valuables, jewelry or cash regardless of the value of these items (hereinafter an “Item of Extraordinary Value”), the customer is obliged to demonstrably notify the Operator of this fact at the latest when handing the item over to the Cloakroom attendant. This fact will be indicated on the Ticket and the Item of Extraordinary Value will be deposited in a place designated by the Operator. However, the Operator is entitled to reserve another place for depositing Items of Extraordinary Value outside the Cloakroom and to publish information about it in the same way as these Cloakroom Operating Rules. The customer is obliged to pay the price stated in the Cloakroom price list or communicated by the Operator, for the storage of Items of Extraordinary Value. If the customer does not notify the Operator that an item is an Item of Extraordinary Value, does not pay the price for the storage of an Item of Extraordinary Value according to the Cloakroom price list, does not present the Operator with a marked Ticket or does not deposit the items in the Operator’s place reserved for depositing Items of Extraordinary Value, if such place is determined, the Operator is not liable for any damage caused, as such item was not deposited in the place designated for reasons on the customer’s part.
  12. Exclusion of liability for items handed over in violation of the Cloakroom Operating Rules. If the customer breaches his/her legal or contractual duties, in particular the duty to notify the Operator of facts or items in accordance with these Cloakroom Operating Rules, he/she will compensate the Operator for the damage resulting from this.
  13. Complaints in connection with the Cloakroom’s operation must be made by the time limit without undue delay, usually on the day of the relevant Event. Later complaints will not be considered. Other facts are governed in particular by these Cloakroom Operating Rules and the Visitor Rules. Personal data processing is governed by the Privacy Policy.
